Welcome to Company X! We provide our services to you subject to the following Terms of Service (“TOS”), which may be updated by us from time to time without notice to you. By accessing and using any part of our services, you acknowledge that you have read, understood, and agree to be bound by these TOS.

1. Acceptance of Terms

By subscribing to or using any of our services, you agree to be bound by these terms. If you do not agree to all of the terms and conditions, do not use our services.

2. Description of Service

Company X offers health and wellness services, including gym access, fitness classes, personal training, and other related services (“Services”). All new features enhancing the current Service shall be subject to the TOS.

3. Membership Obligations

To access and use the Services, you must:

  • Be at least 18 years of age.
  • Provide true, accurate, current, and complete information about yourself as prompted by the Service’s registration form.
  • Maintain and promptly update your registration data to keep it true, accurate, current, and complete.

4. Privacy Policy

Registration Data and certain other information about you are subject to our Privacy Policy.

5. Member Account, Password, and Security

You are responsible for maintaining the confidentiality of your password and account and are fully responsible for all activities that occur under your password or account.

6. Member Conduct

You understand that all information, data, text, photographs, videos, messages, or other materials (“Content”) are the sole responsibility of the person from which such Content originated. You are responsible for all Content that you upload, post, email, transmit, or otherwise make available via the Service.

7. Indemnity

You agree to indemnify and hold Company X, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of Content you submit, post, transmit, or make available through the Service, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another.

8. Termination

Company X may terminate your membership, delete your profile and any content or information that you have posted on the Service and/or prohibit you from using or accessing the Service (or any portion, aspect, or feature of the Service) for any reason, or no pretty, at any time in its sole discretion, with or without notice.

9. Modifications to Service

Company X reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.

10. Disclaimer of Warranties

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:
YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. COMPANY X EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

COMPANY X SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES RESULTING FROM YOUR USE OF THE SERVICE.

12. General Information

The TOS constitutes the entire agreement between you and Company X and governs your use of the Service, superseding any prior agreements between you and Company X. The TOS and the relationship between you, and Company X shall be governed by the laws of England and Wales without regard to its conflict of law provisions.

Gym Health and Safety Policy

Gym Usage Terms and Conditions Policy

Welcome to Company X Health & Wellness Fitness Studio. By using our gym facilities, you agree to adhere to the following terms and conditions. Please read these carefully to ensure a safe and enjoyable environment for all members and staff.

1. Membership Eligibility and Fees

  • Eligibility: Membership is available to individuals who are 18 years of age or older. 
  • Fees: Membership fees are payable monthly in advance or in full upfront for annual memberships. Class credits included within memberships are valid for 1 month and cannot be carried over to the following month. Late payments may result in access restrictions until dues are settled.
  • Membership is valid for a period of 1 year from the date of registration and will automatically renew unless cancelled. We require 1 month’s notice after an initial period of 3 months.

2. Facility Use

  • Hours of Operation: Studio opening hours are displayed on the door and within the booking app,These hours may be subject to change with prior notice. Access is strictly limited to members only.
  • Proper Usage: Equipment and facilities must be used for their intended purpose only. Misuse may result in injury and/or membership termination. Any damage caused by negligence will be the responsibility of the member.

3. Personal Conduct

  • Respect: Respect towards staff and fellow members is mandatory. Harassment, intimidation, or any form of discriminatory behaviour will not be tolerated.
  • Attire: Appropriate fitness attire is required. This includes gym shoes, shirts, and pants/shorts. Inappropriate clothing may be grounds for denial of entry.

4. Health and Safety

    • General Health: Members must be in good health to use facilities. Members with contagious conditions are asked to refrain from gym use until medically cleared. Members must disclose any medical conditions or injuries to the studio prior to participating in training sessions; failure to do so could result in the studio refusing participation if it is deemed unsafe for the member. 
    • Injury: Any accidents or injuries must be reported to staff immediately.
    • Hygiene: Members are required to use hygiene and sanitation measures, including wiping down equipment after use and utilising hand sanitizer.
  • Safety: It is important that all safety guidelines and regulations are followed while using the facilities and participating in classes or programmes. 

5. Equipment and Facilities

  • Care and Reporting: Care for equipment and facilities. Report any malfunctioning or broken equipment to staff. Do not attempt to repair or adjust any equipment yourself.
  • Personal Belongings: Company X is not responsible for lost or stolen items. Secure all personal belongings in designated areas.

6. Fitness Classes

  • Pre-registration: Members must pre-register for fitness classes. Spaces are available on a first-come, first-served basis.
  • Cancellation: If you cannot attend a class you have registered for, please cancel your booking as early as possible to allow access for other members.

7. Group Training Sessions

    • Small Group Membership: Members with Small Group Membership are entitled to attend both large and small group training sessions according to the schedule provided by the studio. Small group sessions will be limited by the membership level purchased. If a member wishes to attend additional small group sessions, they must upgrade their membership to a higher tier.
  • Large Group Membership: Members with a Large Group Membership are only entitled to attend large group training sessions according to the schedule by the studio. If a member wishes to attend small group sessions they must upgrade their membership to include small group sessions.
  • PAYG: Pay as you go membership is available, classes are limited to large group classes only.

8. Suspension and Termination

  • Breach of Terms: Failure to adhere to these terms and conditions may result in the suspension or termination of membership.
  • Voluntary Termination: Members may terminate their membership as per the terms outlined in the Membership Agreement.

9. Amendments

  • Policy Changes: Company X reserves the right to amend the terms and conditions at any time. All amendments will be effective immediately upon posting in the facility and, if applicable, on the website.

Company X Health & Wellness Fitness Studio Liability Waiver

Welcome to Company X Health & Wellness Fitness Studio! Your health and safety are of utmost importance to us. Before you commence your fitness journey with us, we require all members and guests to acknowledge and agree to the following terms and conditions related to the use of our facilities, participation in activities, and use of equipment.

1. Acknowledgment of Risks

I acknowledge that the activities I engage in while on the premises involve the inherent risk of physical injury or other damages, including but not limited to, heart attacks, muscle strains, pulls or tears, broken bones, shin splints, heat prostration, knee/lower back/foot injuries, and any other illness, soreness, or injury, however caused, occurring during or after my participation in the physical activities. I further recognize that there are many other risks of injury, including serious disabling injuries, which may arise due to my use of the facilities and I voluntarily assume the risks associated with such participation.

2. Representation of Health

I represent that I am in good physical condition and have no medical reason or impairment that might prevent me from my intended use of Company X’s facilities. I acknowledge that Company X did not give me medical advice before I joined, and cannot give me any after I join, relating to my physical condition and ability to use the facilities. If I have any health or medical concerns now or after I join, I will discuss them with my doctor before using the facilities.

3. Liability Waiver and Release

In consideration of being allowed to participate in and access the facilities and services provided by Company X, I hereby (a) agree to assume full responsibility for any and all injuries or damage which are sustained or aggravated by me in relation to the gym activities, (b) release, indemnify, and hold harmless Company X, its direct and indirect parent, subsidiary affiliate entities, and each of their respective officers, directors, members, employees, representatives and agents, and each of their successors and assigns and all others, from any and all responsibility, claims, rights, causes of action, and/or liability from injuries or damages to my person or property resulting, directly or indirectly, from my participation in the gym activities, and (c) represent that I have no medical or physical condition which would prevent me from attending and/or using any of Company X’s services and facilities and/or put me in any physical or medical danger, and have not been instructed by a physician not to do so.

4. Acknowledgment of Understanding

I have read this waiver and release and fully understand its terms. I understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the waiver freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.

Integrity and Fairness

  • Uphold the principles of fairness, honesty, and integrity in all interactions within the facility.
  • Use the facilities, services, and equipment for their intended purposes and refrain from abuse or misuse.
  • Honour the commitments made to personal training sessions, classes, or appointments by arriving on time or providing timely cancellation notices.

Compliance with Laws and Policies

  • Abide by all applicable laws as well as the policies and procedures set forth by Company X, including membership agreements, terms of service, privacy policy, and this code of conduct.
  • Avoid any activity that may lead to the unauthorised practice of regulated professions (e.g. medical advice, physical therapy) unless appropriately licensed and authorised by Company X.

Accountability

  • Members are responsible for their conduct and any consequences that may result from a violation of this code of conduct.
  • Company X reserves the right to revoke or suspend memberships for conduct in violation of this policy.

Reporting and Enforcement

  • Any concerns, complaints, or violations of this Code of Conduct should be reported immediately to Company X management.
  • Company X management will investigate all reported incidents promptly and confidentially to ensure compliance with this policy.

To ensure that all patrons can achieve their health and fitness goals in a professional and respectful atmosphere, the following gym rules must be adhered to at all times.

1. General Conduct

  • Respect Others: Maintain a considerate and respectful demeanour towards all members and staff. Abusive language, harassment, or any form of discrimination will not be tolerated.
  • Safety First: Adhere to all safety instructions and recommendations. Do not engage in reckless behaviour that could endanger yourself or others.

2. Dress Code

  • Wear appropriate fitness attire at all times. Closed-toe, athletic shoes are mandatory; street shoes and sandals are prohibited in exercise areas.
  • Clothing that may be deemed offensive or inappropriate by staff should be avoided as a courtesy to other members.

3. Equipment Use

  • Handling Equipment: Use equipment only as intended. Do not misuse weights or machinery.
  • Clean Equipment After Use: Wipe down all equipment with provided disinfectants after each use to maintain cleanliness and hygiene.

4. Personal Belongings

  • Store all personal items in lockers. Company X is not responsible for lost or stolen items.
  • Keep the workout area free from bags, bottles, and personal items for safety and cleanliness.

5. Health Guidance

  • If you are feeling unwell or have been in direct contact with someone who has been diagnosed with a communicable illness, please refrain from attending the gym until cleared by a medical professional.

6. Food and Beverages

  • Only sealed water bottles or non-spill drink containers are allowed in workout areas. No food or open drink containers are permitted.

7. Age Requirements

  • Members must be 18 years or older to use weight and cardio equipment. 

8. Media and Photography

  • Photography and video recording are restricted within the gym area to protect the privacy of others unless prior permission has been obtained from management.

9. Compliance and Consequences

  • Non-compliance with these rules may result in a warning, suspension of membership privileges, or termination of membership, depending on the severity of the infraction.

10. Changes to Rules

  • Company X reserves the right to amend these rules at any time. Updates will be communicated through official channels.
